1. About us
Spek & Boonen, represented by Bjorn Boonen, is an artisan butcher shop with registered office at Blaesstraat 155, 1000 Brussels, Belgium, registered with the Crossroads Bank for Enterprises under BE 0696 943 317.
We aim to offer you the finest, ethically produced meat products, with respect for both animal and nature.
2. Definitions
- Vendor, we, us: Spek & Boonen
- Customer, you: every natural or legal person who purchases a product
- Consumer: every customer who is a natural person and purchases a product for exclusively non-professional purposes
- Professional: every customer who is not a consumer
3. Applicability
These general terms and conditions apply to all agreements between Spek & Boonen and you. By placing an order, you accept these terms.
4. Our offer
4.1 Product description
Our products are made by hand with the greatest care and attention to quality. Small variations in appearance and weight are possible and underline the authentic character of our wares.
Although our products are deboned and prepared with the greatest care and craftsmanship, small fragments of bone or cartilage may occasionally remain due to the artisanal nature of our work. Consumption should therefore be carried out with normal caution.
4.2 Prices and offers
Our prices include VAT, unless otherwise stated. Offers are valid while stocks last. We reserve the right to change prices and to refuse orders.
4.3 Allergen and nutritional information
Information on allergens and nutritional values is available in our shop and on request. In case of doubt, we advise you to contact us before purchase.
5. Order and payment
5.1 Formation of the agreement
An agreement is concluded after our confirmation of your order.
5.2 Payment term
Payment must be made within the term stated on the invoice.
5.3 Procedure for non-payment
In the event of non-payment, we will send you a free first reminder containing:
- The amount to be paid
- Our name and company number
- A description of the product delivered or service provided
- The date on which the debt became due
- A minimum waiting period of 14 calendar days for payment
After this period (plus 3 business days for sending by post), we may charge default interest and a compensation amount in accordance with the statutory maxima.
5.4 Retention of title
The delivered products remain our property until full payment of the invoice.
6. Delivery
6.1 Delivery periods
Our delivery periods are indicative. If a delivery period is exceeded by more than 30 days, the Consumer has the right to dissolve the agreement free of charge.
6.2 Transfer of risk
The risk passes to you upon delivery. We advise you to be present at the agreed delivery time to ensure the optimal quality of our fresh products.
7. Right of withdrawal for Consumers
Due to the perishable nature of our fresh products, the right of withdrawal does not apply to these items. For non-perishable products, the Consumer has the right to withdraw from the agreement within 14 days.
8. Warranty and complaints
8.1 Statutory warranty
For Consumers, the statutory warranty of 2 years applies for conformity defects. For Professionals, warranties are limited to those of the manufacturer.
8.2 Complaints procedure
Complaints about the quality of fresh products must be reported within 24 hours of purchase or delivery. For non-perishable goods, a term of 8 days applies. Submit your complaint in writing or by e-mail to info@spek-n-boonen.be.
In order to investigate a complaint or any claim for damages (whether concerning quality or the presence of foreign objects), the Customer is required to keep the product in question or the physical evidence and make it available to us. If the product has been discarded or fully consumed, the right to lodge a complaint or claim compensation lapses.
9. Liability
As far as legally permitted, our liability is limited to direct damage up to a maximum of the purchase price of the product. We are not liable for indirect damage or damage caused by force majeure.
10. Food safety and storage
We comply with all applicable standards for food safety and hygiene. After purchase, you are responsible for the proper handling and storage of the products. We advise you to consume our products as soon as possible for optimal quality and safety.
11. Privacy
We process your personal data in accordance with our privacy statement, available on our website.
12. Applicable law and disputes
Belgian law applies to all agreements. In the event of disputes, the courts of Brussels have exclusive jurisdiction.
13. Final provisions
If a provision of these terms is null and void, the remaining provisions remain in full force. We reserve the right to amend these terms.
